Welcome to ResqPal (“ResqPal,” “we,” “our,” or “us”). These Terms and Conditions govern your access to and use of the ResqPal mobile application, website, software, communication channels, content, products, and services (collectively referred to as the “Platform”).

By creating an account, accessing, browsing, downloading, or using ResqPal, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions. If you do not agree with any provision contained herein, you must immediately discontinue use of the Platform.

These Terms constitute a legally binding agreement between you and ResqPal.

Purpose of the Platform

ResqPal is designed to provide users with access to support resources, educational content, wellness guidance, communication tools, referrals, informational materials, and other services intended to promote personal well-being, awareness, and support.

ResqPal may also facilitate communication between users and support personnel, partner organizations, community resources, or other service providers where applicable.

The Platform is intended to supplement available support resources and should not be considered a substitute for professional medical care, psychological treatment, psychiatric services, emergency intervention, legal advice, or other professional services.

Eligibility

To use ResqPal, you must be at least eighteen (18) years of age, or have the consent of a parent or legal guardian where permitted by law. You must be capable of entering into a legally binding agreement and provide accurate and complete registration information, maintaining its accuracy at all times.

ResqPal reserves the right to request verification of age, identity, or eligibility at any time.

User Accounts

Users may be required to create an account in order to access certain features.

You are responsible for maintaining the confidentiality of your login credentials, restricting access to your account, ensuring that information associated with your account remains accurate, and all activities conducted through your account.

You agree to notify ResqPal immediately if you become aware of any unauthorized access or security breach involving your account.

ResqPal shall not be liable for losses arising from unauthorized use of your account resulting from your failure to protect your credentials.

User Conduct

Users agree not to violate any applicable law or regulation, submit false or misleading information, harass or abuse others, upload malicious software, attempt unauthorized access to systems or data, interfere with platform security or operations, impersonate others, or use the Platform for unlawful purposes.

Violation may result in suspension or termination of access.

Mental Health, Wellness, and Support Communications

ResqPal may provide educational resources, wellness information, guidance materials, referrals, recommendations, and support communications.

Where appropriate, ResqPal may contact users via phone calls, SMS, email, push notifications, or in-app messaging when support is requested, follow-up assistance is beneficial, safety concerns are identified, or additional guidance may help.

These communications do not establish a doctor-patient, therapist-patient, counselor-client, attorney-client, or other professional relationship.

Crisis and Emergency Situations

ResqPal is not an emergency service and does not provide emergency intervention or crisis response.

If you are experiencing a medical, psychiatric, or safety emergency, you should immediately contact local emergency services, a qualified healthcare provider, or relevant crisis hotlines in your region.

Reliance on ResqPal in place of emergency services is entirely at your own risk.

Marketing and Promotional Communications

By using ResqPal, you consent to receive communications including product updates, educational content, awareness campaigns, newsletters, surveys, and promotional materials via SMS, email, push notifications, or in-app messaging.

You may opt out of marketing communications using available unsubscribe mechanisms.

Transactional Communications

ResqPal may send essential service-related communications such as account verification, password resets, login alerts, security warnings, subscription notices, billing confirmations, service updates, policy changes, and support responses. These may continue even if marketing communications are disabled.

Intellectual Property Rights

All intellectual property including software, source code, databases, logos, trademarks, text, graphics, designs, user interfaces, and content remain the exclusive property of ResqPal or its licensors.

No rights or licenses are transferred to users except as expressly stated. Users may not copy, modify, reverse engineer, redistribute, or commercially exploit any part of the Platform without prior written consent.

Third-Party Services

The Platform may contain links or integrations to third-party services. ResqPal is not responsible for third-party content, privacy practices, or actions. Users engage with third parties at their own discretion and risk.

Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis without warranties of any kind regarding availability, accuracy, reliability, or completeness.

Limitation of Liability

ResqPal shall not be liable for any indirect, incidental, consequential, or special damages, including loss of income, data, profits, or emotional distress arising from use of the Platform. Use is at your own risk.

Indemnification

You agree to indemnify and hold harmless ResqPal and its affiliates from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, infringement of rights, or unlawful conduct.

Suspension and Termination

ResqPal may suspend or terminate access at any time without notice in cases of violation of these Terms, suspected fraud, security risks, or legal requirements.

Changes to These Terms

These Terms may be updated periodically. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by applicable laws within the jurisdiction of operation, and disputes shall be subject to competent courts within that jurisdiction.
